TERMS & CONDITIONS

Dragon Performance Perth Ltd – Terms of Business

By submitting this form and/or instructing work, you agree to the following terms:

1. Definitions

“Company” refers to Dragon Performance Perth Ltd and, where applicable, Powerflow Perth Ltd.
“Customer” refers to the person or business instructing the work.
“Vehicle” refers to any vehicle delivered to the Company.
“Work” includes servicing, repairs, diagnostics, fabrication, exhaust systems, tuning and ECU calibration.

2. Estimates & Additional Work

All estimates are provisional unless confirmed in writing as a fixed quotation.
If additional faults or issues are identified during inspection or dismantling, we will contact you before proceeding with further work.

3. Deposits, Cancellation & Payment

A deposit may be required to secure your booking.
Deposits may be retained where cancellations are made within 48 hours of the booking or where bespoke parts have been ordered.
Full payment is due upon completion and prior to vehicle collection.
The Company retains the right to hold the vehicle until full payment has been received.

4. Vehicle Collection & Storage

Vehicles must be collected within 3 working days of completion unless agreed otherwise.
Storage charges may apply thereafter.
Vehicles not collected within a reasonable timeframe may be treated as abandoned, and the Company reserves the right to recover outstanding sums in accordance with applicable law.

5. Pre-Existing Faults

The Company is not liable for pre-existing faults, wear and tear, or underlying issues that become apparent during or after the Work.

6. Mechanical & Servicing Warranty

Labour is covered by a 3 month or 3,000 mile warranty (whichever occurs first).
Customers must notify the Company in writing within 7 days of becoming aware of an issue and cease use of the vehicle where further damage may occur.
Warranty excludes wear and tear, misuse, overheating, track use, unrelated failures and consequential damage.
Parts are covered only by manufacturer warranties.

7. Seized, Corroded & Aged Components

Due to the age and condition of vehicles, components such as bolts, studs, clamps, sensors and fixings may be seized or corroded.
The Company is not liable for damage caused during removal of such components.
Replacement of these items will be chargeable.
The Company may refuse to refit unsafe or compromised parts.

8. Diagnostics

Diagnostic time is chargeable regardless of outcome.
The Company is not liable for faults that were not reasonably detectable at the time of inspection.

9. Performance Tuning & ECU Calibration

Performance tuning increases mechanical stress and carries inherent risk.
No specific power or torque figures are guaranteed.
The Customer confirms the vehicle is mechanically sound prior to tuning.
The Company is not liable for failures of engine, turbo, gearbox, clutch, drivetrain or cooling systems unless caused by proven negligence.
The Company is not liable for loss of data, software issues, or problems arising from prior modifications or third-party software.

10. Exhaust Systems – Lifetime Guarantee

Custom exhaust systems fabricated under Powerflow Perth Ltd are guaranteed for the lifetime of the original purchaser’s ownership of the vehicle.
This covers corrosion failure and weld integrity under normal road use.
It does not cover damage caused by impact, misuse, track use, third-party modifications or changes in sound preference.

11. Sound Characteristics

Exhaust sound is subjective and cannot be guaranteed.
Requests for changes based solely on sound preference may incur additional charges.

12. MOT, Emissions & Road Legality

The Company does not guarantee that a vehicle will pass an MOT following performance or emissions-related work.
Responsibility for legal compliance rests with the Customer.

13. Track & Motorsport Use

No warranty is provided for failures arising from track or competition use.

14. Customer-Supplied Parts

No warranty is provided on customer-supplied parts.
The Company is not liable for defects, compatibility issues or failures relating to such parts.

15. Test Drives & Insurance

The Company may road test vehicles for diagnostic and verification purposes.
The Customer confirms the vehicle is insured and roadworthy unless otherwise declared.

16. Timeframes

Any timeframes provided are estimates and may vary depending on parts availability, additional work required or unforeseen issues.

17. Photography & Marketing

The Company may take photographs or videos of vehicles for record-keeping and marketing purposes unless the Customer requests otherwise in writing.

18. Limitation of Liability

Liability is limited to the value of the work carried out.
Nothing in these terms excludes liability for death or personal injury caused by negligence.

19. Governing Law

These terms are governed by the law of Scotland.

20. Acceptance

By submitting this form and/or instructing work, you confirm that you have read, understood and agree to these Terms and Conditions.
